Welcome to The Neighbor List
Please note: The Neighbor List is currently in its Beta phase. During this time, features, processes, and terms may evolve based on user feedback and testing. We appreciate your participation and flexibility as we refine the platform.
Thank you for joining The Neighbor List, a referral-based home service network dedicated to connecting high-quality, trustworthy professionals with homeowners seeking dependable work. By enrolling as a Service Provider ("Provider", "you", "your") in our network, you agree to the terms and conditions outlined below, which constitute a binding legal agreement between you and The Neighbor List, LLC ("The Neighbor List", "we", "us", "our"). ("Referral Term"). A "referral" is defined as any client introduction, match, or job opportunity initiated or facilitated by The Neighbor List.
1. Nature of the Relationship
You acknowledge and agree that:
You are an independent contractor, not an employee, agent, joint venturer, or partner of The Neighbor List.
You are solely responsible for the manner and means of performing your services, including hiring and compensating your employees or subcontractors.
You are not entitled to any employee benefits or protections offered by The Neighbor List.
2. Eligibility and Compliance
By joining The Neighbor List, you agree to:
Accurately disclose your licensing and insurance status.
Only offer services you are legally allowed to perform under local, state, and federal laws.
Notify us promptly if your legal eligibility, licensing, or insurance status changes.
Assume full responsibility for the services you provide.
We welcome skilled providers at all levels of experience, including those who are just starting out. If you are not yet licensed or insured, you may still participate only if:
The services you offer do not legally require a license or insurance in your area.
You agree to be clearly identified to clients as “Independent / Unlicensed / Uninsured” for applicable jobs.
You acknowledge and accept all legal and liability risks associated with your work, and you agree to hold The Neighbor List harmless for any related issues.
We reserve the right to limit or deny access to the referral network for any services that legally require a license or insurance which has not been properly obtained.
Additionally, you confirm that:
You are at least 18 years old and legally capable of entering into binding agreements, or under 18 and operating a registered business with written consent from a parent or legal guardian who assumes responsibility.
You and your business are properly licensed, bonded, and insured where required by law and industry standards.
You will notify us immediately of any changes to your licensing or insurance status.
Neither you nor your business representatives have been convicted of a felony involving dishonesty, fraud, or violence.
3. Service Standards
You agree to:
Perform all services in a professional, timely, and workmanlike manner.
Treat all clients with respect, honesty, and integrity.
Comply with all applicable federal, state, and local laws, regulations, and safety standards.
The Neighbor List reserves the right to suspend or terminate your access to referrals if your service quality falls below our standards, or if we receive complaints regarding your conduct or workmanship.
4. Referral Model
The Neighbor List operates on a pay-after-completion referral model. We charge a referral fee, as agreed upon in advance, only when a job is successfully completed and paid by the client.
All referred jobs must be reported to us at the time they are scheduled, including the scheduled date of service. Additionally, jobs must be reported again within 5 days of client payment for proper tracking.
To confirm proper referral fee assessment, providers must submit a copy of the original paid invoice within 5 days of payment.
Referral fees are due within 7 business days of receiving client payment. Late payments are subject to a fee in accordance with applicable state laws, and we reserve the right to assess a standard late fee beginning on the 14th calendar day after payment is due.
The Neighbor List retains exclusive ownership and management rights over all referred clients for a period of 12 months from the original referral date.
During the Referral Term:
Any additional work, service, or engagement performed for the referred client by the same provider is considered part of the original referral and is subject to the same referral fee agreement.
If a provider fails to maintain timely communication, deliver high-quality service, follow up appropriately, or violates the service standards outlined in this agreement, The Neighbor List reserves the right to reassign that client to another provider within the network.
Clients may be released from exclusivity and considered the provider’s long-term client only if The Neighbor List issues written confirmation of release, typically after strong client satisfaction and demonstrated service follow-up.
Providers may request early release of a referred client by submitting a written request with supporting documentation (e.g., communication history, proof of completed service, and client satisfaction). Release approval is at the sole discretion of The Neighbor List.
5. No Guarantees
We do not:
Guarantee a specific number of referrals or earnings.
Represent or warrant the accuracy, completeness, or quality of any job request.
Guarantee that a client will hire you, complete payment, or remain communicative.
· Guarantee that your availability, pricing, or preferred service areas will match client needs or requests.
· Guarantee any level of exclusivity in service categories or geographic areas.
· Guarantee protection from negative reviews or disputes, though we may facilitate limited resolution support at our discretion.
Participation in The Neighbor List network does not constitute a contract for employment or guaranteed business outcomes. Providers are encouraged to use their own discretion and due diligence before accepting or performing any job referred through the platform.
6. Content, Reviews, and Promotions
You grant us a non-exclusive, royalty-free license to use your business name, logo, images, and reviews submitted by clients for promotional and listing purposes.
You may not manipulate reviews, misrepresent your services, or impersonate other businesses.
7. Privacy and Data
You agree to keep all client information confidential and only use it to perform the requested service.
You may not sell, share, or use client information for marketing purposes outside of the referred job.
8. Indemnification
You agree to defend, indemnify, and hold harmless The Neighbor List, its affiliates, officers, agents, and employees from any claims, damages, liabilities, or expenses (including attorney's fees) arising from:
Your services or actions.
Your breach of this agreement.
Any disputes or issues between you and a referred client.
We may terminate this agreement at any time, with or without cause. Grounds for termination may include, but are not limited to:
Consistent failure to pay referral fees on time.
Poor performance or repeated customer complaints.
Failure to meet our core values of professionalism, reliability, respect, and quality service.
Misrepresentation of services, licensing, or qualifications.
Use of The Neighbor List branding or client information outside the scope of this agreement.
Breach of any terms outlined in this agreement.
You may terminate this agreement by providing written notice and settling any outstanding balances.
Upon termination:
You must cease using The Neighbor List’s branding and client information.
You remain liable for referral fees for any jobs completed prior to termination
10. Arbitration and Governing Law
All disputes arising from this agreement shall be resolved by binding arbitration in the state of South Carolina. You waive your right to participate in a class action lawsuit or class-wide arbitration.
This agreement shall be governed by and construed under the laws of the State of South Carolina without regard to conflict of law principles.
11. Amendments
We may update these Terms at any time. You will be notified of material changes. Continued participation in The Neighbor List following notice of changes constitutes acceptance of the new terms.
